Abstract:

In the 19th century, international law developed in an epistemological atmosphere that was dominated in Europe by universalism and rationalism. Supported by the positivist current of this era, these paradigms set the empiricist philosophical framework in which law—without affection or favor—was promoted as true authority governing among states, individuals, and the latter’s relation to the state. The formal genesis of law grounding the validity of law has also defined the criteria of “modernity”. However, the new challenges of globalization, its transnational and immaterial flows have called its positivist epistemology into question. They thus also unveiled the emotional dimension of international law that took a decisive turning point in the late 18th century, that witnessed a simultaneous dominion of reason and the raise of individuals in the legal thinking and on the international scene. This development has reached an unprecedented dimension with the intensification of globalization. While scratching the common positive assumptions of law and international law, emotions contribute to redefine the blurry lines of the Global North and South. How can fear, trust, enthusiasm, outrage, or anger shape the normative production and its practice? To what extent does the affect international law and international relations? I will invite you to explore the emotional dimension of international law through the example of state sovereignty of the Ottoman empire at the turn of the 20th century.
